TERMS AND CONDITIONS

  1. INTRODUCTION

These Terms and Conditions (“Terms”) govern your use of the United States Travel Insurance Association (“USTIA,” “we,” “our,” or “us”) website, membership program, conferences, training programs, reports, and related services (collectively, the “Services”). By accessing or using our Services, you agree to be bound by these Terms.

  1. DEFINITIONS
  • “Association” refers to the United States Travel Insurance Association.
  • “Member” refers to any company or individual who has paid for and been accepted into USTIA membership.
  • “User” refers to any individual who accesses our website or uses our Services.
  • “Registration” refers to the process of signing up for conferences, training programs, or purchasing reports.
  • “Content” refers to all materials, information, data, and resources provided through our Services.
  1. MEMBERSHIP

3.1 Eligibility

Membership is available to companies and individuals involved in the travel insurance industry who meet our membership criteria and are approved by USTIA.

3.2 Membership Fees

  • Membership fees are payable in advance on an annual basis.
  • Fees are non-refundable except as specifically provided in these Terms or as required by law.
  • We reserve the right to modify membership fees with notice to Members.

3.3 Membership Benefits

  • Access to member-only content and resources
  • Discounted rates for conferences and training programs
  • Networking opportunities with industry professionals
  • Additional benefits as determined by USTIA

3.4 Termination of Membership

  • Members may cancel their membership at any time by providing written notice.
  • USTIA reserves the right to terminate or suspend any membership for violation of these Terms, industry regulations, or for any other reason at our discretion.
  • No refunds will be provided for terminated memberships due to violations of these Terms.
  1. CONFERENCES AND TRAINING PROGRAMS

4.1 Registration

  • Registration is required for all conferences and training programs.
  • Registration is complete only upon receipt of full payment.
  • Early bird pricing, when available, applies only to payments received by the specified deadline.

4.2 Fees and Payment

  • All fees must be paid at the time of registration unless alternative arrangements have been approved.
  • Payments can be made via credit card, wire transfer, or other methods specified during the registration process.
  • All transactions will be processed in US Dollars.

4.3 Cancellations and Refunds

  • Cancellations received 30 days or more before the event date will receive a full refund less a $50 administrative fee.
  • Cancellations received 15-29 days before the event date will receive a 50% refund.
  • No refunds will be issued for cancellations received less than 15 days before the event date.
  • Registrations may be transferred to another individual within your organization at no charge.

4.4 Changes to Programs

  • USTIA reserves the right to modify conference or training program content, speakers, venue, or schedule.
  • In the event of cancellation by USTIA, registrants will receive a full refund or credit toward a future event.
  1. REPORTS AND PUBLICATIONS

5.1 Purchase

  • Reports and publications are available for purchase through our website.
  • Pricing varies based on membership status and the specific report or publication.

5.2 Digital Delivery

  • Digital reports will be delivered to the email address provided at purchase.
  • Access to digital reports may require login credentials.

5.3 Licensing and Usage

  • Reports and publications are provided for the purchaser’s use only.
  • Redistribution, reproduction, or sharing of reports without express written permission is prohibited.
  • Citation of data from reports must include appropriate attribution to USTIA.

5.4 Refunds

  • Due to the immediate availability of digital content, purchases of digital reports and publications are non-refundable.
  • Claims regarding defective or incomplete reports must be submitted within 7 days of purchase.
  1. INTELLECTUAL PROPERTY

6.1 Ownership

  • All content, including but not limited to text, graphics, logos, images, audio clips, digital downloads, and data compilations on the USTIA website and in our reports and publications is the property of USTIA or its content suppliers and is protected by United States and international copyright laws.

6.2 Limited License

  • We grant Users a limited, non-exclusive, non-transferable license to access and use our Services for personal or internal business purposes.
  • This license does not include the right to:
    • Modify, reproduce, or distribute any content
    • Use any data mining, robots, or similar data gathering methods
    • Use our Services for any commercial purpose without prior written consent
  1. USER CONDUCT

Users agree not to:

  • Violate any applicable laws or regulations
  • Infringe upon the rights of others
  • Submit false or misleading information
  • Interfere with the proper functioning of the Services
  • Attempt to gain unauthorized access to any portion of our Services
  • Use our Services to transmit any harmful code or material
  1. PRIVACY

Our Privacy Policy governs the collection, use, and disclosure of personal information provided by Users. The Privacy Policy is incorporated into these Terms by reference.

  1. E-COMMERCE TRANSACTIONS

9.1 Payment Processing

  • All payments are processed through secure third-party payment processors.
  • By providing payment information, you represent that you are authorized to use the payment method.
  • We do not store complete credit card information on our servers.

9.2 Order Confirmation

  • Upon successful completion of a purchase, you will receive an email confirmation.
  • Please contact us if you do not receive confirmation within 24 hours.

9.3 Pricing and Errors

  • All prices are listed in US Dollars unless otherwise specified.
  • We reserve the right to correct any pricing errors and to modify prices at any time.
  • If we discover an error in the price of items you have ordered, we will inform you and give you the option of reconfirming your order at the correct price or canceling it.
  1. DISCLAIMERS AND LIMITATIONS OF LIABILITY

10.1 Disclaimer of Warranties

  • EXCEPT AS EXPRESSLY PROVIDED, OUR SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
  • WE DO NOT WARRANT THAT OUR SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE.

10.2 Limitation of Liability

  • TO THE FULLEST EXTENT PERMITTED BY LAW, USTIA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.
  • OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS SHALL NOT EXCEED THE AMOUNT PAID BY YOU TO USTIA DURING THE 12 MONTHS PRECEDING THE CLAIM.

10.3 Indemnification

  • You agree to indemnify and hold harmless USTIA, its officers, directors, employees, and agents from any claims, damages, liabilities, costs, or expenses arising from your violation of these Terms.
  1. DISPUTE RESOLUTION

11.1 Governing Law

  • These Terms shall be governed by the laws of the state where USTIA is headquartered, without regard to its conflict of law provisions.

11.2 Arbitration

  • Any dispute arising from these Terms shall be resolved through binding arbitration in accordance with the American Arbitration Association rules.
  • Arbitration shall take place in the city where USTIA is headquartered.
  • The arbitrator’s decision shall be final and binding.

11.3 Exceptions

  • Nothing in this section prevents either party from seeking injunctive relief in a court of competent jurisdiction.
  1. MODIFICATIONS TO TERMS
  • USTIA reserves the right to modify these Terms at any time.
  • Material changes will be notified via email or prominent notice on our website.
  • Continued use of our Services after such modifications constitutes acceptance of the updated Terms.
  1. GENERAL PROVISIONS

13.1 Entire Agreement

  • These Terms constitute the entire agreement between you and USTIA regarding your use of our Services.

13.2 Severability

  • If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

13.3 No Waiver

  • Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

13.4 Assignment

  • You may not assign these Terms without our prior written consent.
  • We may assign these Terms at our discretion.
